Licensing

Licensing is an area of the law that affects everyone – whether as a businessman; as someone living/working in the vicinity of licensed premises; or as a user of licensed premises. In the latter case you will probably only be interested in what times the premises are open and whether you can take the children there and won’t need our help!! But if you are in the licensed trade or if your business or home is affected by licensed premises the Licensing Act directly affects you and Turner Pearson can help you.

Ever since the firm was founded, Turners, (as it was previously known) has enjoyed a reputation for licensing work involving public houses, clubs, restaurants and other licensed premises. Many firms who "deal" with licensing have someone who has some knowledge of licensing. Turner Pearson has a specialist Licensing Department under the direct supervision of a former Local Authority licensing manager and solicitor, Andrew Bartlett.

The Turner Pearson dedicated licensing team:

►   have handled hundreds of applications and has an awareness and understanding of local political and policy decisions. Variations in interpretation of the law exist between one local authority and another and we have experience of the differing interpretations of all the surrounding authorities (and many more).. In order to avoid unpleasant surprises, the prudent licence holder will scrutinize their licence and confirm the approach of an individual authority.

With the introduction of the Licensing Act 2003, our client base expanded as our reputation for dealing with the demands of the new legislation became widely known.

If you are contemplating buying licensed premises Turner Pearson can help you. Questions need to be asked that result in you knowing exactly what it is that you are acquiring (and whether there is any potential to extend the licensed activities after the purchase is completed). Similarly, if a disposal is contemplated, an assessment of the current licensed activities may indicate that a variation is required in order to maximise the value of the business or widen the range of potential buyers.

►   combines specialist knowledge of licensing law with an appreciation of the differing circumstances individual clients face.

The scope of the Licensing Act 2003 is far reaching and premises providing "late night" refreshment, for example, are now required to have a "Premises Licence" and the potential business opportunities for those already holding a licence have been greatly expanded.

Many licensed premises “converted” their previous licence i.e. they kept what they had under the old legislation but did not expand their licensable activities or their licensing hours. What was good then may not be as good now and it may well be that a change in what you are allowed to do and when you are allowed to do it would be beneficial. See the questionnaire below and assess for yourself whether you could benefit from applying for a variation.

If your business or home is affected by licensed premises you may want to know if there is anything that you can do about the way that the premises operate – Turner Pearson can help you.

This website is intended to give an overview of the Licensing Act 2003 and its implications and is not definitive or intended to cover all possible eventualities or exceptions to general regulations. For a more detailed explanation please contact Turner Pearson.
